The ADA/Section 504 and the Constitution

This article describes the constitutional issues surrounding the Americans with Disabilities Act (ADA). This review is in relation to a 2000 Supreme Court case concerning whether victims of disability-based discrimination could bring lawsuits against state and local governments. The constitutionality of Section 504, which traditionally had allowed suits by private citizens against federally funded agencies, is also discussed.
